Pegwood Cribbage

Terms of Use

These terms apply to the Pegwood Cribbage app (“Pegwood”, “the app”) and the Pegwood pages at https://fairhearth.com/pegwood. Pegwood is made by Arman Malkhasyan, Armenia (“we”, “us”). By downloading or using Pegwood you agree to these terms. If you do not agree, please do not use the app.

1. Your license

Pegwood is licensed to you, not sold, under Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These terms add to the Standard EULA; if the two conflict, the Standard EULA wins on the license itself.

You may use Pegwood on Apple devices you own or control, for your own personal, non-commercial enjoyment. You may not copy, sell, rent or redistribute the app or its artwork, or use them to build a competing product.

2. Playing fair

Pegwood is built so that every deal can be checked and the computer never sees your cards. Please play in the same spirit. You agree not to:

  • use a modified version of the app, or any tool, to read hidden cards, change deals or scores, or interfere with another player’s game;
  • reverse engineer or attack our game server, or try to access games that are not yours;
  • use bots or automated play in games with other people;
  • send invite links in bulk, or use them to spam or harass anyone;
  • choose a name that is offensive, impersonates someone else, or includes someone’s personal details.

We may change or remove a name that breaks these rules, end a game that was interfered with, or block access to friend games for anyone who abuses them.

3. Games with a friend

Friend games are free and never require Pegwood Pro. They run on our server, which deals the cards, checks every move and keeps the game until it ends. We work hard to keep them reliable, but we cannot promise the service will always be available or free of errors. A game that no one has moved in for a long time may be closed. How long games and invites are kept is described in the Privacy Policy.

You are responsible for who you send an invite link to: anyone with the link can take the empty seat in that game.

4. Verifiable deals

Before each game Pegwood shows a seal of the shuffle, you cut the deck yourself, and after the game you can check every deal with Verify. This lets you confirm that the deals match the seed that was sealed before play. It is offered for transparency; it is not a promise that the app is free of every bug.

5. No gambling

Pegwood is a card game for fun. There are no bets, stakes, coins, prizes or real-money play, and nothing in the app can be exchanged for money. Do not use Pegwood to gamble.

6. Pegwood Pro and purchases

  • What it is. Pegwood Pro is a one-time, non-consumable in-app purchase. It unlocks the Nordic and Lodge tables, the reasoning behind the computer’s discards, the Luck of the Deal and detailed statistics, as described in the app at the time of purchase. If a later version of the free game shows ads, Pro keeps them away. It is not a subscription and never renews.
  • Who sells it. Purchases are made through the App Store and processed by Apple under Apple’s terms. The price is shown in the App Store and on the Pro screen before you buy, in your local currency.
  • Family Sharing. Pro is available to your Family Sharing group, as set by Apple.
  • Restoring. You can restore Pro on your devices with the same Apple Account using Restore Purchases in the app.
  • Refunds. Refunds are handled by Apple, not by us. You can ask for one at reportaproblem.apple.com.
  • Changes. We may improve Pro over time. For as long as we offer Pegwood, we will not take away the main reasons you bought it: the premium themes you unlocked and the analysis and statistics features.

7. Ads

Pegwood shows no ads today. If a later version adds ads to the free game, they will appear only between games: never during a game, never in your first session and never right after a loss. The ad provider will be responsible for their content, and we will ask for ads suitable for all ages. Pegwood Pro keeps them away.

8. Apple services

The App Store, in-app purchases and notifications are provided by Apple under Apple’s own terms. We are not responsible for their availability.

9. Our content

The app, its code, artwork, card designs, board, sounds, name and logo belong to us or to our licensors. You may share screenshots and recordings of your games for non-commercial purposes.

10. Feedback

If you send us ideas or suggestions, we may use them to improve Pegwood without owing you anything. Thank you.

11. No warranty

We make Pegwood with care, but it is provided “as is” and “as available”. To the extent the law allows, we make no promises beyond those in these terms – for example, that the app will always be available, error-free or suited to a particular purpose.

12. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses, or for loss of data, games or statistics. Our total liability to you for any claim about Pegwood is limited to the amount you paid for Pegwood Pro in the 12 months before the claim, or US$10 if you paid nothing.

Nothing in these terms limits rights you have as a consumer that cannot be limited by contract – for example, under the Australian Consumer Law or UK consumer law – or our liability for death or personal injury caused by negligence, or for fraud.

13. Ending

You can stop using Pegwood at any time; to have your friend-game data removed from our server, write to [email protected] (see the Privacy Policy). We may suspend access to friend games for anyone who seriously breaks section 2. Sections 5 and 9 to 14 survive the end of these terms.

14. Governing law

These terms are governed by the laws of Armenia, without regard to its conflict-of-law rules. If you are a consumer resident elsewhere, you keep the protection of the mandatory law of your country of residence and may bring proceedings there.

15. Apple

These terms are between you and us, not Apple. Apple is not responsible for Pegwood or its support. Apple and its subsidiaries are third-party beneficiaries of the Standard EULA and may enforce it.

16. Changes to these terms

We may update these terms when the app changes. We will update the date at the top, and tell you in the app about any change that matters. If you keep using Pegwood after a change, the new terms apply.
